Just let Biden choose who he wants for SCOTUS
White men have been the default choice for the nation’s highest court forever, now they’re mad the president wants someone else
The most obvious beneficiary of any affirmative action program in US law is conservative lawyers, now conservatives are mad that president Biden is pledging to nominate a Black woman for the Supreme Court of the United States.
Under former president Trump, ten judges rated not qualified by the American Bar Association were nominated and confirmed to lifetime positions federal court position based on nothing but the fact that they were conservative.
Biden, however, has never nominated a judge deemed not qualified for any of his 71 federal court nominations. We don’t yet know who he will nominate for the position opened up by Justice Stephen Breyer’s retirement, but there’s no reason to believe she’ll be unqualified for the job or less qualified than other judges.
That hasn’t stopped conservatives from going all out on the attack this weekend, claiming that Biden was racist for only considering Black women for the open SCOTUS slot, or making racist assumptions that the eventual nominee won’t be as smart or qualified as someone who had to “beat out” white competitors for the job.
But here’s the thing, 108 out of 115 SCOTUS justices in the history of the United States have been white men. Do you really think that all through human history that all of those men were the absolute best choices for the job, above and beyond any white women or people of color? No, obviously.
Those white men benefitted from a system which gave them an advantage in seeking an education, building a career, and yes, getting chummy political appointments. It’s not wrong now to recognize that Black women have never had a say in the nation’s most important legal decisions and seek to rectify that situation.
Critics claim that doing this would be just as racist as the original system that resulted in all those white men getting those appointments, all the while advocating to uphold the very system that put all those dudes on the court in the first place.
I think conservatives and edgy white liberals should chill out and let Biden do his job, without making assumptions about the intelligence or temperament of a hypothetical Black woman nominee. It’s not a good look.
